Terms and Conditions for Consumers

Capitalized terms have the meanings given in the glossary at the bottom of this page.

1. Using our Services

1.1 You must be at least 18 years old to take up our Services.

1.2 The Consumer Terms apply to the Services we provide when you use a consumer Plan. If you are using a business Plan, please refer to our Business Terms.

1.3 During a support call, our agents may remotely access your SC Internet supplied modem to help resolve performance issues. SC Internet has no visibility of your personal data or browsing history. If you wish to opt-out of remote access, you can do so by contacting us.

2. Length of Services

2.1 The starting date of your contract is the same date as your Services start working, unless another date is provided in your Specific Terms.

2.2 If you have signed up for a fixed contract term, you agree to receive the Services for that full amount of time. Once this time is up, we will continue providing the Services to you on a month-by-month basis, until you cancel them.

2.3 Services will not carry over unless stated in your Plan terms.

3. How We Provide Our Services

3.1 We will take reasonable skill and care to provide you with Services in a reasonable timeframe, ensuring our Services do what we say they will. While we strive for consistent service, there are factors beyond our control, such as third-party systems or technologies. We may need to temporarily stop a Service for maintenance. Therefore, we cannot guarantee that our Services will always be available, meet your needs, or remain uninterrupted.

3.2 We may decide how to provide a Service and the technology used. We may ask for information, assistance, or consents to install our Equipment or provide Services. You must use Equipment compatible with our network to receive our Services.

4. Payment and Billing

4.1 Unless you use our consumer Prepay Services, we will bill you monthly by post or online. For online billing, we will notify you via email and/or text when your bill is ready. Physical billing may incur an additional charge.

4.2 You may change your billing method at any time but must provide notice if switching from online to paper billing.

4.3 You must pay your bill on time, or we may:

  • Charge you a late payment fee.
  • Suspend or cancel your Service.
  • Pass your debt to a collection agency, who will then have the right to collect the debt.

4.4 If we receive an amount from you that is less than what you owe, we may allocate that amount towards your outstanding bills in an order we choose.

4.5 All Charges include GST unless otherwise stated.

4.6 You are responsible for all Charges incurred through the use of our Services by any party except:

  • Charges incurred due to our error or negligence.
  • Unauthorized charges, unless the use was due to your negligence or carelessness.

4.7 We will not pay interest on any credit balances or deposits in your account.

4.8 We may charge a reasonable fee for managing inactive accounts. Unused credit on Prepay accounts is non-refundable.

5. Credit Checks

5.1 You allow us to run credit checks and ongoing assessments. If you do not meet our standard credit requirements, we may restrict or stop your Service.

6. Changing Your Services

6.1 Changes that benefit or are neutral to you: We may make changes without notice if they benefit you.

6.2 Changes that disadvantage you: If we make a change that disadvantages you, we will give you 30 days’ notice or as much notice as possible.

6.3 Changing your Plan: You may change your Plan, but additional terms may apply. A transfer fee may apply for fixed-term contracts.

6.4 Moving premises: You must provide at least one month’s notice before moving.

6.5 Discontinued Plans or Services: If we stop offering a Plan or Service, we will move you to a comparable alternative.

7. Ending Your Service

You:

7.1 If you cancel a fixed-term contract before it ends, an Early Termination Charge may apply. If you cancel due to a change that disadvantages you (under 6.2), no Early Termination Charge will apply, but you must still pay any outstanding amounts.

7.2 To cancel a Service, you must give us 30 days’ notice. We may charge for the full notice period even if you request an earlier disconnection.

7.4 We may restrict, suspend, or terminate your Service for reasons outlined in the table below. If we cancel your Service, unused entitlements will be lost.

7.5 We may terminate your Service immediately if you engage in prohibited activities such as sharing objectionable content or attempting unauthorized access.

7.6 We may impose conditions or fees during a suspension or reconnection.

8. Equipment and Property

8.1 You must not tamper with our Equipment. Only SC Internet or its agents may perform repairs.

8.2 You are responsible for our Equipment if it is lost, stolen, or damaged while in your possession.

8.3 If we need to install Equipment, you are responsible for obtaining consent from your landlord if required.

8.4 Your phone number is allocated to you by us, but you do not own it.

8.5 You are responsible for your home wiring. If you request a fault investigation and it turns out to be a wiring issue, you may incur a charge.

9. Liability

9.1 These Terms do not affect your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986. If you use the Services for business, these Acts do not apply.

9.2 Your liability: You are liable for breaches of contract except for those caused by us.

9.3 Our liability: We are not liable for:

  • Loss of data.
  • Indirect or consequential loss.
  • Any loss outside our control.

10. Safety and Security

10.1 You are responsible for maintaining the security of access codes or passwords for your account.

10.2 We cannot guarantee perfect security for the information passing over our network.

11. Contacting You

11.1 We may contact you via email or text using the details you provided.

12. Miscellaneous

12.1 Transferring our part: We may transfer this Agreement without notice.

12.2 Transferring your part: You must obtain written consent to transfer this Agreement.

12.3 Governing law: New Zealand law applies.

Charges: The fees for using our Services.
